GDPR Note: The Rules Are More Relaxed for Private Birthdays

The legal situation in a nutshell:

Private parties (family, friends):

GDPR doesn't apply here. You're taking photos in a private setting — that's legally completely fine. As long as you don't share the photos publicly (e.g. on Instagram without permission), you're safe.

Semi-public parties (e.g. a work birthday with colleagues):

Here it gets a little more complicated. In principle: if guests upload photos voluntarily, that's fine. But: let people know in advance that photos will be shown on a projector.

Public sharing:

If you want to post photos on social media later: get permission first! Either by email ("May we share photos on Instagram?") or at the event itself ("If you do NOT want photos of you on Instagram, please let us know").

• No sharing with third parties
• Photos can be deleted automatically after the event

How many guests need a smartphone?

Not all of them! Realistically, 70–80% of your guests have a smartphone. The other 20–30%? They can ask someone to take photos for them. Or share a phone.

Practical tip: If you know grandma doesn't have a smartphone, ask her granddaughter to upload photos together with her.

Does it work without a projector?
