Welcome to Event Photowall. These terms of use govern the use of our services, including our website and our Interactive Slideshow App Event Photowall ("Service"). Please read these terms carefully before using our Service.

By using our Service, you accept these terms of use and our privacy policy. If you do not agree to these terms, you may not use our Service.

1 Service Description

Event Photowall is an online service that allows users to transfer images from their smartphone to an online slideshow. Images can be reviewed by the system depending on settings (Google image and video moderation) and text moderation is also carried out via Google. Images can be moderated by the event administrator and subsequently downloaded and made available to guests.

2 User Account

To use certain features of our Service, you may need to create a user account. You are responsible for the security of your account and for all activities that occur through your account. We reserve the right to suspend accounts if we detect a violation of these terms of use.

3 Privacy and Security

We take the protection of your personal data very seriously. Our privacy policy describes how we collect, process and protect your data. The privacy policy forms part of these terms of use.

When you use the Service, sessions with an ID are stored for security purposes, and a browser fingerprint is taken to enable recognition. If you do not wish to provide personal data, no personal data will be collected. Data is only collected in the case of voluntary participation in a prize draw.

4 User Conduct and Prohibited Activities

When using our Service, you agree to:

  • Not engage in any illegal or unethical conduct
  • Not upload any offensive, defamatory, vulgar, obscene, pornographic or hateful content
  • Respect the rights of other users and third parties
  • Not distribute malware or harmful code
  • Not use our Service for spam or unsolicited advertising
  • Not use the Service in any manner that could damage, disable or overload it

5 Copyright and Intellectual Property

You retain all rights to the content you upload via our Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free licence to use, publish and distribute that content in connection with the operation and provision of our Service.

You declare that you hold all necessary rights to the uploaded content and that uploading it does not infringe the rights of any third parties.

6 Right to One's Own Image

General

Every identifiably depicted person has a fundamental right to their own image. This means that recordings may only be distributed or publicly displayed with the consent of the person depicted.

Group Photos

For group photos, the following applies: if people appear only as incidental figures alongside a landscape or other location, or if the images depict gatherings or similar events in which the depicted persons participated, no consent is required.

Public Events

At public events, please note:

  • Persons attending the event must expect to be photographed.
  • However, the same rule applies: individual shots of a person should not be shared publicly without their consent.
  • Particular care should be taken when publishing photos on social media.

Private Events

At private events such as weddings or company celebrations:

  • The organiser may establish rules for photography.
  • Consent may be given implicitly if the photo wall is clearly identifiable as such.
  • However, caution is advised and explicit consent is generally required when sharing or publishing images.

Withdrawal

Every person has the right to withdraw their consent and request the deletion of images. This request must generally be complied with.

7 User Responsibilities

The user is responsible for ensuring they hold the appropriate rights to uploaded content. This means in particular:

  • Only uploading images for which the user holds the copyright or has the appropriate permission
  • Not uploading images that infringe the right to one's own image without the consent of the depicted persons
  • Not uploading content that violates applicable law

8 Image Review and Moderation

Uploaded images may be automatically reviewed by Google services for image, video and text content. In addition, images may be moderated by the event administrator. We reserve the right to remove inappropriate content that violates these terms of use without prior notice.

9 Availability and Changes to the Service

We strive to keep our Service available around the clock, but cannot guarantee permanent availability. We reserve the right to change or discontinue the Service temporarily or permanently at any time, with or without prior notice.

10 Limitation of Liability

To the extent permitted by law, we accept no liability for direct, indirect, incidental, special or consequential damages arising from the use of or inability to use our Service. We provide no guarantee as to the security, accuracy or availability of our Service.

11 Indemnification

You agree to indemnify and hold harmless us and our employees from and against all claims, losses, liabilities and expenses (including legal fees) arising from your use of our Service or your violation of these terms of use.

12 Changes to the Terms of Use

We reserve the right to amend these terms of use at any time. For material changes, we will notify you via our Service or by email. Your continued use of the Service after such changes constitutes your acceptance of the amended terms.

13 Termination

We may suspend or permanently block your access to our Service if we have reasonable grounds to believe you have violated these terms of use. You may cease using our Service at any time.

14 Applicable Law

These terms of use are governed by and construed in accordance with German law. Any disputes relating to these terms or the Service are subject to the exclusive jurisdiction of the German courts.

16 Severability Clause

Should individual provisions of these terms of use be or become wholly or partly invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose of the invalid provision.
