Terms of Service

Welcome to Event Photowall. These Terms of Service govern your use of our services, including our website and the Event Photowall App ("Service"). Please read these terms carefully before using our Service.

By using our Service, you accept these Terms of Service and our Privacy Policy. If you do not agree with these terms, you may not use our Service.

1. Service Description

Event Photowall is an online service that allows users to transfer images from their smartphones to an online slideshow. The images can be checked by the system (Google image and video checking) and text checking is also carried out via Google, depending on the settings. The images can be moderated by the event admin and subsequently downloaded and made available to guests.

2. User Account

You may need to create a user account to use certain features of our Service. You are responsible for the security of your account and for all activities that take place through your account. We reserve the right to block accounts if we detect a violation of these Terms of Service.

3. Privacy and Security

We take the protection of your personal data very seriously. Our Privacy Policy describes how we collect, process and protect your data. The Privacy Policy is an integral part of these Terms of Service.

When you use the Service, sessions with an ID are stored for security purposes, and a fingerprint is taken from the browser to enable recognition. If you do not wish to provide personal data, no personal data will be collected. Personal data is only collected during voluntary participation in a prize draw.

4. User Behavior and Prohibited Activities

When using our Service, you agree to:

  • Not engage in illegal or unethical actions
  • Not upload offensive, defamatory, vulgar, obscene, pornographic or hateful content
  • Respect the rights of other users and third parties
  • Not distribute malware or harmful code
  • Not use our Service for spam or unwanted advertising
  • Not use the Service in a way that could damage, disable or overload it

5. Copyright and Intellectual Property

You retain all rights to the content you upload via our Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, publish and distribute this content in connection with the operation and provision of our Service.

You declare that you have all necessary rights to the uploaded content and that the upload does not violate the rights of third parties.

6. Right to One's Own Image

General

Each identifiably depicted person fundamentally has a right to their own image. This means that recordings may only be distributed or publicly displayed with the consent of the depicted person.

Group Photos

For group photos: If persons appear only as "accessories" next to a landscape or other location, or if the images are of gatherings or similar events in which the depicted persons participated, no consent is required.

Public Events

For public events, please note:

  • Persons participating in the event must expect to be photographed.
  • However, individual photographs of a person should not be shared publicly without their consent.
  • Special caution is advised when publishing photos on social media.

Private Events

For private events such as weddings or company parties:

  • The organizer can establish rules for photography.
  • Consent can be implied if the photo wall is clearly recognizable as such.
  • However, caution is advised when sharing or publishing, and explicit consent is usually necessary.

Revocation

Every person has the right to revoke their consent and request the deletion of images. This request must generally be complied with.

7. User Responsibilities

The user is responsible for ensuring that they have the appropriate rights for uploaded content. This means in particular:

  • Only uploading images for which the user owns the copyright or has the appropriate permission
  • Not uploading images that violate the right to one's own image without the appropriate consent of the depicted persons
  • Not uploading content that violates applicable law

8. Image Review and Moderation

Uploaded images can be automatically checked by Google services for image, video and text content. Additionally, images can be moderated by the event administrator. We reserve the right to remove inappropriate content that violates these Terms of Service without prior notice.

9. Availability and Changes to the Service

We strive to keep our Service available around the clock, but we cannot guarantee permanent availability. We reserve the right to modify or discontinue the Service temporarily or permanently at any time, with or without prior notice.

10. Limitation of Liability

To the extent permitted by law, we assume no liability for direct, indirect, incidental, special or consequential damages resulting from the use or inability to use our Service. We do not guarantee the security, accuracy or availability of our Service.

11. Indemnification

You agree to indemnify and hold harmless us and our employees from all claims, losses, liabilities and expenses (including legal fees) arising from your use of our Service or from violations of these Terms of Service by you.

12. Changes to the Terms of Service

We reserve the right to change these Terms of Service at any time. For significant changes, we will notify you via our Service or by email. Your continued use of the Service after such changes constitutes your agreement to the modified terms.

13. Termination

We may temporarily or permanently block your access to our Service if we have reasonable grounds to believe that you have violated these Terms of Service. You may terminate your use of our Service at any time.

14. Applicable Law

These Terms of Service are subject to German law and shall be interpreted in accordance with it. Disputes in connection with these terms or the Service are subject to the exclusive jurisdiction of the German courts.

16. Severability Clause
